Published picture?

We received a request through someone on Flickr who would like to use a picture of Maggie in a book of funny cat pictures. There's no pay, although Mom and Dad would get a photo credit. We're debating giving them permission. It would be kind of fun, and we would get a copy of the book if the picture is actually included. But we just get apprehensive about giving the rights out, ya' know.

You never know if you should say yes to these things. Esp since they aren't paying you for it.

I'd do it if it feels right to you. That's how I do things like this.

That is an awesome photo! I would look more into the book - who is publishing it, etc. It could be a really small publisher with no budget, but if it is a medium or big publisher, they should pay you something. And you should never, ever give up exclusive rights. You should just give the rights to use the photo for the book and retain all other rights for the photo. Whether there is pay involved or not. Send me a message via my blog (at the top, there is a contact link), with the details if you want my opinion - my human's business is publishing so she might be able to offer more insight.

Be very clear about what rights you'd be giving them to use the picture. If you say yes you could find yourself in the future wanting to use it for something else and then not being able to.

I'd consider north american rights ONLY, absolutely NO digital rights, with rights for reprint in magazines, etc requiring new written permission.

If they don't have a publisher already...say no. If it's an indie writer...maybe.

But first, find out what rights they want...it might be simple and you may be retaining all rights post-print. That's what I do, I always give rights back...

Thanks for the feedback. Mom and Dad may have sat on this for too long anyway. But they'll look into it and report back.
